Cracking Down on Fraudulent Tax Preparers in Texas
Specific cases of fraud are my favorite blog articles. A CPA in Houston Texas has been barred from practice before the IRS. The IRS and Karen Hawkins have disclosed the suspension of Robert Loeser. Mr. Loeser has been suspended from practice before the IRS for 12 months.
His scheme went something like this, set up some shell corporations. His clients would then write these companies checks, for fake expenses. The shell company would then reimburse the client. How does this become a deduction? Shouldn’t the shell company have income? But then the shell company’s reimbursement would create income for the client, offsetting any expenses. This is a criminal enterprise, if I have ever seen one.
Why isn’t this CPA, Robert Loeser, in prison? Shame on the Office of Professional Responsibility, this CPA belongs in prison. I do not know if criminal prosecution is within the power of the Office of Professional Responsibility, but why isn’t this CPA in prison?
This man set up a scheme to defraud the government. Texas should revoke his CPA, and the US Government should put him in prison for several years.

My firm, my business partner and my employees, we all work very hard for our clients. I have never been able to understand why a professional would put his clients into that kind of a position. It is one thing if the client wants to cheat or commit a crime, but this is a case of the professional cheating for his clients. I terminate clients that want to cross the line, I cannot understand what would motivate a professional to falsify his client’s tax returns. I do not understand how an individual can violate a fiduciary trust in such an egregious way and remain free. Unfortunately, there is only one place for Mr. Loeser, he belongs in prison. Thanks for reading my blog, next time it won’t take me 2 months to reply.

Robert Loeser told his clients that what he was doing was legal. How is a person supposed to know if a CPA is committing a crime? We have no expertise in tax returns. Robert Loeser destroyed many families.

The answer to your question is, the individual signing the return under penalty of perjury needs to examine and question the tax return. I don’t know if that would have helped. I have seen cases where the practitioner is so nefarious and devious that an individual’s questions would not have unraveled the crime. You the consumer were supposed to be protected by the practitioner’s license and the ethical requirements to hold that license. That is why CPA’s are personally liable for our work, so that my CPA license assures the consumer that what I am doing for you is in your best interest. As a CPA, my firm and all my employees have a fiduciary duty to do what is in our client’s best interest. That said, the victims of Mr. Loeser probably have a tough road ahead, they probably need to seek representation, but their problems should not destroy a family.
